Kristin Cole will be sentenced next month in August death of husband on US-8

A Shafer woman will go before a 10th Judicial District Court judge next month for sentencing in connection with the death of her husband during a domestic incident on US-8 in August.

Kristin A. Cole, 41, will be sentenced on Monday, Jan. 26 by Judge James Dehn on one count of criminal vehicular operation resulting in death with a blood alcohol level of .10 or more as measured within two hours of driving.

Cole entered a guilty plea in October to the one felony count and three additional charges related to criminal vehicular operation were dismissed, said Chisago County Attorney Kathryn Johnson this week.

Cole was arrested and charged after a late night August incident on US-8 in Wyoming Township that injured her husband, Mark Allen Cole. The incident took place in the 7000 block of Lake Blvd. just east of Greenway Avenue.

Mark Cole was a passenger in a vehicle driven by his wife. Police reports said the two were involved in a domestic dispute in the early-morning hours on Aug. 17.

Authorities said Mark Cole left the vehicle and was walking along the shoulder of US-8 when he attempted to jump on the hood of the car. When Kristin Cole stopped the car, her husband flew off the vehicle striking his head, according to a reconstruction report by the Minnesota State Patrol.

He was airlifted to North Memorial Medical Center where he was pronounced brain dead and later died from the head injuries.

Kristin Cole could face jail and or a fine as a result of the guilty plea entered in October.

Johnson said a conviction can result in a sentence of up to 10 years in prison and/or a fine of up to $20,000. She said Cole is free of custody and awaiting the sentencing hearing next month in Center City.
